Mr. Massand is an experienced intellectual property attorney, commercial litigator and registered patent attorney. He concentrates his practice on patent litigation and patent prosecution. Additionally, he advises clients on other aspects of intellectual property, including due diligence, licensing, copyrights, and trademarks.

Mr. Massand has been named by Super Lawyers as a Rising Star in 2009 and 2012-2015.

​Mr. Massand has assisted numerous clients in drafting patent applications and preparing infringement, validity and freedom to operate opinions. Mr. Massand has also assisted numerous clients in the acquisition and/or sale of intellectual property assets. In addition, Mr. Massand has assisted numerous clients in their patent monetization efforts. This includes, in part, assisting a technology company in patent infringement litigation related to online community selected content, representing a technology company in patent infringement litigation related to augmented reality, representing a technology company in patent litigation related to wireless tethering, representing an online recruiting company in patent litigation related to database access, representing technology company in patent litigation related to software and data transfer, and representing a patent holding company in patent infringement litigation related to speedometers and speeding notification.

Represented patent holder in obtaining favorable settlement prior to appeal; represented patent holder in bench trial of Walker-Process antitrust and patent unenforceability claims; represented patent holder in bench trial of action to recover injunction bond.
  • Educational Media Foundation v. Chermion Enterprises, Inc.; Cause No. 2:11-cv-00119-J in the United States District Court for the Northern District of Texas, Amarillo Division. Represented trademark holder in infringement action leading to favorable settlement.
  • VocalSpace LLC v. Larkspark Corporation and Daniel D. Lorenso; Cause No. 4:09-cv-00350 in the United States District Court for the Eastern District of Texas, Sherman Division. Represented software copyright holder in action involving claims of copyright infringement and theft of trade secrets. Successfully obtained summary judgment on nearly all claims and counterclaims leading to favorable settlement.
  • Certain Surface Mount MEMS Microphones and Products Containing the Same; Inv. No. 337-TA-700 in the International Trade Commission. Represent accused infringer in patent litigation, including trial.
  • Clear Choice Holdings, LLC v. Dale D. Goldshlag, DDS; Opposition No. 91191371 before the Trademark Trial and Appeal Board. Represent trademark holder in opposition action.
